Gene Policastri is a founding partner at Mirsky Policastri LLC, a law firm designed to focus on the clients and their desire to improve their situation. His background is rich in the variety of the types of trials and disputes in which he has successfully advocated his clients’ interests. Gene’s experience provides superlative representation of clients in court, arbitration and depositions. The typical dispute involves a contract that is being breached or obligations under it that are not being met, and the resolution requires a combination of effective negotiation simultaneous with effective courtroom advocacy.

Gene has been a lawyer since 1989, first being admitted to practice in Louisiana and practicing maritime law. He relocated to the D.C. area in June of 2000 and since that time has focused his practice on construction and commercial litigation with an emphasis on protecting the rights and interests of architects and engineers during all phases of projects but particularly in the construction administration phase.

Gene offers his experience in civil, commercial and construction litigation to help you work through your disputes avoiding unnecessary conflict whenever possible. Gene has a history of successful representation of architects and engineers providing counsel during the construction administration phase, trial counsel during litigation and arbitration, and providing general counsel services such as review and writing of corporate documents, contract negotiation, employee agreements and advice on protecting copyrights associated with the design.

The following are examples of his recent work:

• Defense of a closely held corporation operating a chain of radio stations – they were sued on fraudulently obtained promissory notes worth millions of dollars.

• Represented investors in a commercial real estate limited liability company in a dispute over distributions and breaches of the duties owed under the operating agreement.

• Negotiated favorable terms and conditions for a civil engineering firm vis-a-vis the developer of a commercial development in Prince George’s County.

Gene is the current co-chair of the construction committee of the American Bar Association’s solo and small firm practice section. He has provided continuing education seminars to engineers and is an approved continuing education provider by the American Institute of Architects. He is a member of the construction law section of the Maryland State Bar Association, and of both the Fairfax and Montgomery County Bar Associations.

Gene graduated cum laude from Tulane Law School in 1989 and prior thereto graduated from Colgate University in 1983 with a B.A. Gene lives in Kensington. He is married to Valerie Young, a lawyer and public policy analyst.  Together they are raising two children, a son and a daughter.

Recently, Gene has developed  expertise in providing general counsel services to business and life coaches nationwide. He is enrolled in a certification program for lawyers who provide services to the coaching industry. He is developing a program for business and life coaches to assist them with their internal corporate documents, contracts with clients, joint – venture agreements with other coaches, media rights agreements at live events, and other intellectual property agreements.
